The First Amendment… “Congress shall make no law…abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” - HONOR MISSING IN SAN CLEMENTE Dear City of San Clemente's building department, I have nothing to hide and I only speak that which is truth. Our family has no political agenda. We only decided to speak out only after many attempts to get the City of San Clemente to be honorable failed. We are just a family who has decided to stand up as family to the bullies and dishonesty in the building department of the city of San Clemente. Please know how hard this is on our family, it is painful to watch my family suffer so much and for so long. They, like me, believe in a person doing the correct thing, with integrity and honesty. We live in this mess day in and day out from 2004 to 2009 now. Our fourth daughter Lauren was just in the eighth grade when we moved here to this house in San Clemente and what breaks my heart is that she will be leaving for college this coming June 2009, with only nightmares of the devastation this has brought to our family by the city of San Clemente. She never enjoy a yard, only the pain that it has brought inside. My children have never been able to play in the backyard. To make matters worse they have had to suffer the teasing of neighborhood kids, who think along with a lot of our other neighbors that we just ran out of money. "Your dad can't afford to even buy a driveway" or "My family hates looking at your house". My children just have to take it, because we have tried to believe that the right thing would soon be done and we have lived in fear for the last two years, if we spoke the truth. I will no longer sit by and be silent. The neighbors are sick of my children always playing in the street, but really they have no choice. Just in case you forgot, we still have an 8-foot deep cement hole just steps out our back door. No gates to keep anyone out or fence to keep the coyotes from running wild threw our back yard at night. You see, I must leave everything as it is, or I have tampered with evidence and risk losing my case. Please try to feel the pain we endure daily. I believe your building department is accountable. EVERYTHING SHOULD HAVE STOPPED AT THE PERMIT DESK. We are sitting on a million dollar mess. My PRETEND general contractor built a full bathroom attached, a large viewing deck and a 164-foot retaining wall with caissons. Needless to say we found out that the city's inspector for our home was on the take. He and my contractor are buddies. A city inspector never visited my home to check his friends work, I am guessing he signed the inspection cards at the Angel games, or one of the many other brides he took from our pretend contractor. We exposed the illegal behavior and all the city of San Clemente did was fired the inspector. We are left with the mess and after hundreds of thousands of dollars worth or investigating and legal fees we have discovered a very expensive mess. Where is your responsibility to the five others in just my neighborhood, our family makes it six. Six families who deserve to have the city double check that things were done correctly and by those who were properly licensed. Our back fence is as dangerous as an electric chair if touched by a wet child. It conducts electricity from one post to the next, not to mention all of the other life threatening dangers posed by my landscaping. We have an 8 foot deep cement hole just steps from our back door ( a hazard waiting to happen with six kids and neighborhood children), mold from the leaking irrigation lines and a yard that is slipping with the slope. All of this would never have happened if you had only done your job. You turned your back on those who were unknowingly damaged. Is the cost too great to send an honest inspector back to review those homes which were worked on by dishonest inspectors and an illegal contractor? Did you stop and weigh the cost benefits… Even one life damaged is too much. I can look myself in the mirror, I have been to court and paid a lot of money to fight for the right to speak out. The truth is a perfect defense. Remember GM MOTORS, and what happened to them… The city of San Clemente’s cover up is beginning to ring familiar. .....GM had known about the defect since the early 1970s and had not remedied the defect or warned the public. In an accompanying statement, Secretary Pena accused GM management of having “made a decision favoring sales over safety.”.... The building department should have a warning sign on the door stating that the permits you are about to pay for are good for two things, paper and ink. Period. What happened to plan check and all those people who are paid by our tax dollars to make sure this kind of thing doesn’t happen. IF YOU ARE NOT RESPONSIBLE FOR THIS THEN WE REALLY DON’T NEED TO HAVE A BUILDING DEPARTMENT, DO WE? My children are trapped in this mess now for over one and a half years. The stress has been affecting everything in our lives. Everyday I look out at the backyard and realize that it may cost our family everything we have worked so hard for. You see, it costs a lot of money for the right thing to be heard in a court of law. Yet, even more tragic is those families who the city had a duty to protect, took their money for permits and now families are resting on the integrity of an inspector who was on the take. When we first discovered the illegal behavior, your own senior building inspector tried to bully us into going back to an unlicensed contractor, to let him finish the job and stop causing problems for the city of San Clemente. I am ashamed to remember how I let you and your employees at the city manipulate, scare, and threaten us into silence. So come what may, I am more concerned with being able to look myself in the mirror if damage to a life occurs. Will you be able to do the same? I looked up, stood up, and educated the public about what they deserved to know. We have no landscaping and it is now 2009. The worst part of all is how you tried to cover up this corruption in your city and hid the failure of duty to many homeowners who trusted that the city's building department actually acted with honor. ___________________________________________________________________________ Our family moved into San Clemente at the end of October 2004. We could not have been more excited, our neighbors, and this wonderful community we are so honored to be a part of. Our home was new and needed to be landscaped, so when an inspector for the City of San Clemente personally visited our home (February 14, 2005,) and recommended Dennis Toussieng from T.L.C. for all our construction needs. We felt confident and called him for an interview. We questioned him and checked his references to make sure he was a general contractor that could be trusted. I personally spoke with one person who said that they had not experienced any problems with him. He had worked on five other houses in our track and had the city's seal of approval, it seemed. (Only later did we learn that a city building official isn't allow to recommend a contractor to a home owner.) We went ahead and hired Dennis Toussieng (TLC) we felt it was safer to hire the general contractor who was personally recommended by the City of San Clemente, than an unknown. We had plans drawn up and gave them to Dennis Toussieng along with a check for $5,000. to start the job on June 27th, 2006 after waiting eight long months for Mr. Toussieng to be able to start our job. He told us he would be submitting our plans to the city and getting the needed permits. I guess when you have buddies working down at the city's building department you can build anything you want to licensed or NOT. He showed us his paperwork and told us he was fully licensed to do the job. How were we to know he was unlicensed and had been performing illegal construction on four houses on our street and a total of six counting us in this track alone. This nightmare should have never been allowed to happened, Mr. Dennis Toussieng should have been stopped at the permit desk in the City of San Clemente and told - - "I am sorry Mr. Toussieng but you are NOT licensed to build this level of a construction project." - This one sentence would have saved our family grief beyond our worst nightmare and hundreds of thousands of dollars- Isn't that what you pull city permits for?????????? I guess the only the paper it is written on and the ink. That is where it begins and ends. The city of San Clemente allowed him to pull permits that were illegal, knowing he wasn't licensed to perform the work. Now we have been living in the mess everyday for years . What happened to honor in this city of San Clemente that we now call home?
