These Terms of Service (“Terms”) govern your access to and use of fingerprint.to, operated by BigData LLC (“Fingerprint”, “we”, “us”, “our”). By accessing or using the platform, you agree to these Terms.
1. Description of Service
Fingerprint is a digital intelligence platform that searches publicly available information across 400+ online platforms. The service allows users to look up usernames, names, and email addresses to discover associated online accounts and public data.
Fingerprint is designed for legitimate use cases including, but not limited to, cybersecurity research, digital footprint awareness, brand protection, fraud prevention, identity verification, and reconnecting with individuals you have lost contact with.
2. FCRA Disclaimer
Fingerprint is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (“FCRA”), 15 U.S.C. § 1681 et seq. The data provided by Fingerprint does not constitute a “consumer report” as defined by the FCRA.
You must not use Fingerprint or any information obtained through Fingerprint to:
- Make decisions regarding consumer credit, insurance, employment, tenant screening, or any other purpose regulated by the FCRA
- Determine an individual's eligibility for credit, insurance, employment, housing, or any other benefit
- Evaluate an individual for debt collection purposes
- Assess risk for any consumer-initiated business transaction
By using Fingerprint, you certify that you will not use the service or its data for any purpose covered by the FCRA or any analogous state law. Violation of this provision will result in immediate termination and may result in legal action.
3. Account Registration
To use Fingerprint, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You are responsible for all activity under your account.
4. Acceptable Use
You agree to use Fingerprint only for lawful purposes. By using the service, you represent and warrant that you have a legitimate and lawful reason for each search you conduct.
You must not use the service to:
- Stalk, harass, threaten, or intimidate any person
- Publish private information about individuals with intent to harm (doxing)
- Make any determination of eligibility for credit, insurance, employment, housing, education, or any benefit regulated by the FCRA or equivalent state laws
- Collect debts or assess risk for any consumer-initiated transaction
- Violate any applicable local, state, national, or international law
- Conduct unauthorized surveillance of any individual
- Circumvent any access controls or security measures on third-party platforms
- Scrape, redistribute, sublicense, or resell data obtained through Fingerprint without prior written authorization
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service for any form of discrimination prohibited by law
- Use automated tools, bots, or scripts to access the service beyond the rate limits of your plan
Violations may result in immediate account termination without refund and, where applicable, referral to law enforcement.
5. Public Data
Fingerprint only accesses and aggregates publicly available information. We do not:
- Hack, breach, or access private systems
- Bypass authentication or security mechanisms
- Access data behind paywalls or login walls on your behalf
- Guarantee the accuracy, completeness, or currency of results
Search results reflect publicly available data at the time of the query. We are not responsible for the accuracy of information published by third parties.
6. Pricing and Payment
- Free tier— available with rate limits as described on our pricing page.
- Paid plans— billed on a recurring monthly basis. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
- Cancellation— you may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period.
- Refunds— we do not offer refunds for partial billing periods. If you believe you were charged in error, contact [email protected] within 30 days of the charge.
- Price changes— prices are subject to change with at least 30 days' advance notice. Continued use after a price change constitutes acceptance.
- Payment processing— payments are processed by our third-party payment processor. By subscribing to a paid plan, you agree to the payment processor's terms of service in addition to these Terms.
- Enterprise— custom pricing and terms available upon request.
7. Intellectual Property
All content, branding, software, and technology comprising Fingerprint is owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the platform.
Data returned from searches is sourced from public records and third-party platforms. We do not claim ownership of third-party data.
8. Disclaimer of Warranties
Fingerprint is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The service will be uninterrupted, secure, or error-free
- Results will be accurate, complete, or current
- The service will meet your specific requirements
9. Limitation of Liability
To the maximum extent permitted by law, Fingerprint and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the service
- Any unauthorized access to or use of our servers
- Any interruption or cessation of service
Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Fingerprint from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the service, violation of these Terms, or infringement of any third-party rights.
11. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any reason with notice. You may delete your account at any time through your account settings.
Upon termination:
- Your right to access the service ceases immediately
- We will handle your account data in accordance with our Privacy Policy
- Provisions that by their nature should survive termination will survive
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
13. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association, except where prohibited by law. You retain the right to bring claims in small claims court.
Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Fingerprint.
14. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fingerprint regarding your use of the service, and supersede any prior agreements.
16. Changes to Terms
We may update these Terms at any time. Material changes will be communicated with at least 30 days' notice via email or platform notification. Continued use after changes take effect constitutes acceptance.
